These Terms and Conditions apply to your access to and use of the On Demand Hire website, web app, mobile application, and related services.

1. Acceptance of Terms

By registering an account, continuing to use the Platform, or checking an acceptance box where shown, you agree to be legally bound by these Terms. If you use the Platform on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Definitions

  • "Platform" means the On Demand Hire website, web app, mobile application, and related services.
  • "Business User" means a user who creates, owns, administers, or manages a business account, posts job listings, reviews applicants, accepts or rejects applications, invites business admins, manages business seats, manages subscriptions where authorised, and communicates with accepted workers.
  • "Worker User" means a user who creates a worker profile to discover, save, apply for, and accept construction work opportunities.
  • "User" means any Business User or Worker User.
  • "Job" means a work opportunity, shift, date range, or ongoing role posted by a Business User through the Platform.
  • "Content" means any information, text, profile details, business details, photos, credential evidence, ratings, reviews, messages, or other materials uploaded to or exchanged through the Platform.

3. Nature of the Platform

On Demand Hire operates as a technology platform for introductions and workflow between businesses and workers. On Demand Hire is not a recruitment agency, employment agent, labour hire service, employer, payroll provider, payment processor for work between users, or insurer.

Any engagement between a Business User and a Worker User is a direct arrangement between those users. On Demand Hire is not a party to that arrangement and does not set employment status, pay terms, award coverage, superannuation obligations, tax treatment, insurance coverage, site rules, or the legal basis of the engagement.

Workers are not employees, agents, contractors, or representatives of On Demand Hire. Business Users are responsible for deciding whether and how to engage workers and for complying with all applicable Australian laws.

4. User Accounts and Business Verification

All users must provide accurate and complete account information and keep it up to date.

Business Users must provide a valid Australian Business Number (ABN) when creating a business account. On Demand Hire may use local validation checks and may request additional information, but is not required to independently verify every business, business member, worker, credential summary, or listing.

Business owners are responsible for business-member invitations, admin access, seat selection, and ensuring each invited or active admin is authorised to act for the business account.

Workers do not need an ABN to create or use a worker account unless a separate law or direct engagement arrangement with a business requires one.

5. Platform Features

The current Platform allows Business Users to post jobs, browse worker profiles, save workers, share open listings directly with visible workers, review applications, accept or reject applicants, manage each accepted job, confirm completed jobs, manage business members where authorised, and leave reviews after eligible completed work. Worker Users can create profiles, add skills and certifications, save jobs, apply for jobs, view directly shared listings, chat after acceptance, and review businesses after eligible completed work.

Job listings may include hourly, daily, salary, date, location, category, work-frequency, and must-have information. Users are responsible for checking that any listing, application, acceptance, direct share, and message accurately reflects the intended engagement.

Platform features and plan limits may differ between the mobile app and web app during staged rollout. Some actions may be available only to authenticated users or only to active business owners/admins.

6. Payments, Plans, and Fees

Business owners can manage optional Starter, Pro, and Premium subscription plans through supported app-store payment systems and any subscription provider used to manage access. Subscription purchases, renewals, cancellations, refunds, billing support, payment method issues, and store-account issues are handled by the relevant app store or subscription provider.

Business plan features may include active job-listing limits, saved-worker limits, direct job-share credits, business member seat limits, and owner-only subscription controls. Plan limits are enforced by the Platform and may change if a subscription expires, is cancelled, is downgraded, or cannot be verified.

If a business plan downgrade leaves more active admins than the new plan allows, affected admins may be paused until the business owner selects which members remain active. Paused admins may lose access until reactivated within the plan limit.

On Demand Hire does not process wages, invoices, deposits, or other payments between users. All work-related financial arrangements, including rates of pay, invoices, timing, tax, GST, superannuation, and payment method, are handled directly between Business Users and Worker Users off the Platform.

On Demand Hire is not liable for work-payment disputes, non-payment, chargebacks, tax disputes, or issues about the quality, timing, or completeness of work performed.

7. User Responsibilities

Business Users are solely responsible for conducting due diligence before accepting or engaging a Worker User. This may include checking identity, qualifications, references, licences, certifications, site readiness, right to work, and suitability for the role.

Business Users are solely responsible for deciding and documenting the engagement terms with Worker Users, including contractor status, award coverage, superannuation, tax, GST, right to work, workplace health and safety, insurance, workers compensation, public liability, and labour-hire or licensing obligations.

Business Users are solely responsible for providing a safe work environment that complies with applicable workplace health and safety laws, site rules, award or employment obligations, workers compensation obligations, public liability insurance, and any other legal or insurance requirements that apply to the engagement.

Worker Users are responsible for providing accurate profile, skill, certification, location, availability, language, credential, and application information, and for only applying for or accepting work they are qualified, authorised, and available to perform.

8. Content, Profiles, and Documents

The Platform may allow users to upload profile photos, business images, and worker credential evidence images. Users must only upload Content they have the right to provide, and must not upload misleading, unlawful, offensive, defamatory, unsafe, or privacy-infringing Content.

Workers must not upload driver licences, passports, Medicare cards, TFN documents, bank details, payslips, police checks, Working with Children Check documents, medical records, third-party information, or unrelated identity documents as credential evidence. Police check and Working with Children Check status may be self-declared only in the current MVP.

Prohibited uploads may be deleted, and account access may be restricted or suspended for misuse. Raw worker credential evidence files are private unless a Worker User approves an application-specific Business User request for short-lived access. Workers can decline requests and revoke approved evidence access. Profile photos, business details, credential summaries, ratings, reviews, public business summaries, and other marketplace information may be visible to other users as part of the Platform experience.

9. Messaging and Contact Information

Users may communicate through the Platform after a worker application has been accepted. Users may exchange contact information at their own risk. On Demand Hire is not responsible for conduct, messages, calls, meetings, or communications that occur outside the Platform.

10. Ratings and Reviews

The Platform may allow ratings and reviews after eligible completed jobs. Reviews must be honest, factual, relevant to the completed engagement, and not defamatory, discriminatory, threatening, or misleading. On Demand Hire may remove or moderate reviews where it considers this necessary to protect users, comply with law, or operate the Platform.

11. Prohibited Conduct

Users must not misuse the Platform, create false accounts, post false or unlawful jobs, misrepresent qualifications or business details, scrape or harvest data, interfere with Platform security, harass other users, abuse direct-share, saved-worker, subscription, invitation, notification, or review features, or use the Platform for unlawful, unsafe, discriminatory, or exploitative purposes.

12. Limitation of Liability and Indemnity

You use the Platform and engage with other users at your own risk. On Demand Hire is not liable for the acts, omissions, conduct, safety practices, payment practices, employment decisions, work quality, or legal compliance of any user.

To the fullest extent permitted by the Australian Consumer Law and other applicable laws, On Demand Hire's total liability to you for any claim is limited to the amount you paid directly to On Demand Hire in the six months before the event giving rise to the claim, or AUD $100 if you paid nothing directly to On Demand Hire in that period.

You agree to indemnify On Demand Hire, its directors, officers, employees, contractors, and representatives from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Platform, your Content, your breach of these Terms, your engagement with another user, or any claim about employment status, workplace safety, insurance, payment, injury, property damage, or financial loss connected with a user engagement.

13. Disputes Between Users

Disputes between Business Users and Worker Users are solely between those users. Users agree to resolve disputes directly with each other and release On Demand Hire from liability related to those disputes.

14. Suspension and Termination

On Demand Hire may suspend, restrict, or terminate your account or access to the Platform if you breach these Terms, create risk for users or the Platform, provide false information, misuse Platform features, exceed or evade plan limits, or where required to comply with law. You may request account deletion through the app where available.

15. General

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.

These Terms constitute the agreement between you and On Demand Hire for use of the Platform. On Demand Hire may update these Terms from time to time. Continued use of the Platform after changes are made means you accept the updated Terms.

Mandatory Acknowledgement

  • On Demand Hire is not an employer, recruitment agency, labour hire provider, payroll provider, insurer, or party to any engagement between users.
  • Business Users are responsible for workplace safety, insurance, legal compliance, engagement terms, payment, due diligence, contractor classification, awards, superannuation, right-to-work checks, and labour-hire or licensing obligations.
  • Worker Users are responsible for accurate profiles, qualifications, applications, and work-readiness information.
  • All work payments and payment disputes are handled directly between users off the Platform.
  • Business owners are responsible for subscription plan management, invited admins, seat usage, and plan-limit compliance.
  • You assume the risks associated with using the Platform and engaging with other users.
